Can foreigners own property in Thailand?

Yes, with important distinctions. Foreign buyers can own condominium units freehold within a building’s 49% foreign ownership quota, and can own buildings such as villas in their own name. Land itself cannot be owned outright by foreign nationals — long leasehold structures (30 years, renewable by agreement) and Thai company structures are commonly used, and each carries considerations that call for proper independent legal advice.

How does buying land work for a foreign buyer?

Most foreign buyers secure land through a registered long-term lease, often combined with a right of superficies or separate ownership of the buildings on the land. Structures involving a Thai company exist but must be genuine to be defensible. Thorough due diligence and independent Thai legal counsel are essential before committing to any structure.

What should I check before buying land?

Start with the title deed: a Chanote (Nor Sor 4 Jor) is the strongest class of title, while Nor Sor 3 Gor titles require closer verification of boundaries and survey history. Beyond title, confirm legal road access, zoning and building restrictions, utilities, and any encumbrances registered at the Land Office. A fresh survey and a lawyer’s title search are standard practice, not optional extras.

What are the typical transaction costs?

Thai property transfers typically involve a transfer fee of around 2% of the registered value, plus either specific business tax of roughly 3.3% or stamp duty of 0.5% depending on the circumstances, and a withholding tax that varies with the seller’s situation and holding period. How these costs are split between buyer and seller is negotiable and set out in the sale agreement. Exact figures depend on the property and the parties, so budget on a case-by-case basis.
